The new Conveyancing Quality Scheme (CQS) Core Practice Management Standards (CPMS) and Guidance was updated on 1 st May 2022.

CQS Policies

The CS Partnership has written the technical property policies required in the updated CPMS, which fall outside the scope of risk and compliance, being:

  • Updated SDLT Policy (Requirement 5.16)
  • Updated Leasehold Policy (Requirement 5.17)
  • Updated Policy for dealing with Lenders (Requirement 6.4)

The policies are written in word, so of course, can be tailored by you to suit your firm.

Advice Sheets / Checklists

The updated CPMS has two major themes running through it, both of which will impact your team’s behaviours and documentation that you send to clients.  The first is that your practice must give information to clients in a way that they can understand, and the second is that if your team’s actions are not recorded on every matter, they are treated as though they did not happen.  We have therefore drafted the following advice sheets and checklists:

To send to your clients –

  • Updated SDLT/LTT Advice Sheet, Client Confirmation Forms (SDLT/LTT), and Client Declaration Forms (SDLT/LTT)
  • Explanatory sheet explaining the differences between freehold/leasehold property

To embed either in your CMS or paper files –

  • CQS compliant pre-exchange and pre-completion checklists for sale matters
  • CQS compliant pre-exchange and pre-completion checklists for purchase matters
  • CQS compliant post-completion checklists to reduce requisition numbers

We are delighted to have hosted Tracy Thompson twice at the end of 2022, as she delivered two detailed sessions for our clients.  Tracy is a Law Society Lexcel Assessor, and the Lead Assessor for the Conveyancing Quality Scheme.

The recordings of each session (and accompanying notes) are available for purchase.

The first session – “Demonstrating compliance with CQS” is 3 hours long. It was recorded in October 2022, and is available for £100.00 plus VAT.

The second session – “Conduct effective, compliant and up-to-date file reviews” is 1 hour 15 minutes long, and is available for £50.00 plus VAT.

The templates incorporate our AML and anti-risk onboarding procedures (which cover the Proceeds of Crime Act 2001 (as amended) (“PoCA”), the Terrorism Act 2000 (as amended), and the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 as well as our bespoke anti-fraud and anti-risk elements that have been assimilated from the current SRA’s Risk Outlook, The Law Society’s risk and compliance guidelines, current case law, GDPR,  the industry’s red flags, the new Core Practice Management Standards from CQS and the new Code of Completion requirements.

The CS Partnership has developed a range of best practice workflow documents.

We have written the best practice workflow documentation for:
